By downloading the Engage! source code, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using the Engage! source code. The materials contained in and downloadable from this web site are protected by applicable copyright and trade mark law.
Account Terms
You must be 13 years of age or older to use the Engage! product.
You must provide accurate information upon registration, including your full legal name and a valid email address.
The license applies to use on one domain or for support of one product only. Multiple commercial products supported by multiple instalations of Engage! require one license per installation.
You may not use this product for illegal purposes.
Upon applying for a license to use Engage! for a commercial product, you will be invoiced and payment is required before the license is issued.
The license granted is a non-exclusive, non-transferable and perpetual license to install and use the Engage! product.
The licensee may not transfer, rent, lease, lend, sell, copy, redistribute or sublicense the Engage! software to third parties.
The licensee undertakes not to use the Engage! software in any way that could compete with the Engage! product during the term of this agreement.
The Engage! product may be used free of charge by non-profit organizations and by products and projects that are open source or are not run for the purpose of generating a profit. Commercial companies launching new products (startups) may use Engage! free of charge until they recieve external funding or begin generating revenue from their product.
You agree to receive invoices electronically via the engagecsm.com website.
Payments for Engage! are non-refundable.
Disclaimer
The product provided from the Engagecsm.com site is provided "as is". Lunar Logic Polska sp. z o.o. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Lunar Logic Polska sp. z o.o. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
Limitations
In no event shall Lunar Logic Polska sp. z o.o. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on the engagecsm.com Internet site, even if Lunar Logic Polska sp. z o.o. or a Lunar Logic Polska sp. z o.o. authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. Lunar Logic Polska sp. z o.o.'s total cumulative liability for any and all claims arisng from or in connection with this agreement will not exceed the amounts actually paid to Lunar Logic Polska sp. z o.o. by such customer in the twelve (12) month period immediately preceding the formal written notice of the claim for liability.

Lunar Logic Polska sp. z o.o. may revise these terms of use for its Engage! product at any time without notice. By downloading Engage! you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
Governing Law
Any claim relating to the Engage! product shall be governed by the laws of the country of Poland without regard to its conflict of law provisions.
